Here we describe how we collect and handle the personal information we collected from you (or the insured) during the course of our engagement.
The personal information we collect
In the course of our involvement, it is necessary for us to collect background information of the incident so as to determine its cause. As such, we will require information from (the insured’s) witnesses who were involved or have knowledge of the incident. The personal information we seek invariably include names, addresses, contact details and work history. Objecting us to processing this data may lead to you (the insured) being in breach of the terms and conditions of your insurance policy. We also sketch and photograph any physical evidence of the scene of the incident.
How we collect personal information
We collect personal information mainly from the insured and their workers, through conversation, note taking and conducting interviews. We may also be provided with some background information by the insurers or their loss adjusters prior to our meeting with the insured. In addition, we may seek further information from the Internet resources.
What we use the personal information for
Following our attendance at the site or inspection, we will be required to prepare a report of our findings for our principals (the insurers), which will include the circumstances that lead to the incident. Such findings may be used to determine insurance coverage and any potential recovery from third parties. In addition, the personal information may be used in future legal proceedings or arbitrations.
How we keep the personal information secure
Documents including notes are kept safely. Digital information in computers and cloud storage is password protected.
Sharing personal information
Personal information collected may be shared with our principals, their loss adjusters who handle your insurance claims and legal representatives who have been appointed to assist in the claims. The personal information remains confidential and we will not sell it to advertisers or any third parties.
Using the personal information to make automated decisions
We do not use personal information for any form of automated decision making.
Your rights
In certain circumstances, you may have the right to withdraw your personal information about you if this has led to unwarranted and substantial damage or distress. Please note that such objection can only be directed to processing one’s own personal data and that the reasons for the objection must be justified. Therefore, to respond to such requests we may need to seek advice from our principals, their legal advisors, and our own legal advisors. By exercising this right, it may lead to you being in breach of the terms and conditions of your insurance policy. You cannot exercise this right if you have earlier agreed to the processing.
